By accessing or using Ascend ("the App"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, please do not use the App.

2. Description of Service

Ascend is a gamified fitness and habit tracking application that helps users improve their health through:

• Personalized 42-day workout programs
• Daily habit tracking (workouts, sleep, hydration, steps, nutrition)
• AI-powered food analysis and calorie tracking
• Apple HealthKit integration for automatic progress syncing
• RPG-style progression and gamification elements

3. Subscription and Payments

Ascend offers subscription-based premium features. By subscribing:

• You authorize recurring charges to your payment method
• Subscriptions automatically renew unless canceled at least 24 hours before the renewal date
• You can manage or cancel your subscription through your App Store account settings
• Refunds are subject to Apple's App Store refund policies
• Free trial periods, if offered, will convert to paid subscriptions unless canceled before the trial ends

4. User Responsibilities

When using Ascend, you agree to:

• Provide accurate information during registration and onboarding
• Use the App only for lawful purposes
• Not attempt to reverse engineer, modify, or distribute the App
• Take responsibility for your own health decisions

5. Health Disclaimer

The workout programs, nutrition information, and health tracking features are for informational and motivational purposes only. Before starting any exercise program or making dietary changes, consult with a qualified healthcare professional, especially if you have any pre-existing health conditions.

The AI-powered food analysis provides estimates only and should not be relied upon for precise nutritional information for medical or dietary treatment purposes.

6. HealthKit Data

Ascend integrates with Apple HealthKit to read and write health data including steps, sleep, workouts, and active energy. This data is used solely to provide personalized fitness tracking and is not shared with third parties. You can revoke HealthKit permissions at any time through your device settings.

7. Intellectual Property

All content, features, and functionality of Ascend—including but not limited to text, graphics, logos, icons, images, audio clips, animations, and software—are owned by Ascend or its licensors and are protected by international copyright, trademark, and other intellectual property laws.

8. Limitation of Liability

To the maximum extent permitted by law, Ascend and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, personal injury, or any other damages arising from your use of the App.

9. Termination

We reserve the right to suspend or terminate your access to Ascend at any time, without prior notice, for conduct that we believe violates these Terms of Use or is harmful to other users, us, or third parties.

10. Changes to Terms

We may update these Terms of Use from time to time. Continued use of the App after any changes constitutes your acceptance of the new terms. We encourage you to review these terms periodically.

11. Notifications

By using Ascend, you agree to receive push notifications regarding your workouts, progress, and app updates. You can manage your notification preferences in your device settings at any time.
